BIRTH REGISTRATION
 
SITUATION 1
 
(A)Mother is Malaysian and Father is Malaysian (baby is born after marriage)
(B)Father is Malaysian and Mother is Foreigner (baby is born after marriage)
 
2. A child who was born after parents legal marriage abroad can obtain a Malaysian nationality if his/her father is a citizen of Malaysia and Report of Birth is submitted to the Embassy of Malaysia and be accepted within 1 year of birth (before the child becomes 1 year old). 
 
3. Please bring your child with you to the Embassy for birth registration and filled-up JPN .WN02 (Borang D) form that can be obtained at the Embassy. The registration fee is PLN30 while the attestation fee on translated document is PLN25 per page. Please find below the other required documents for Report of Birth of your child:
 
Father
• Copy of Passport (biometric page only)
• Copy of Birth certificate of Malaysia
• Copy of Malaysia IC with front & back in 1 page
• 2 copies of Certificate of marriage (if the marriage certificate is in Polish/Lithuanian, it must be translated into English and endorsed by the Ministry of Foreign Affairs of Poland/Lithuania)
• Copy of Malaysia Marriage Registration Certificate
• Copy of Residence Card or Visa to Stay Legally in Poland/Lithuania with front & back in 1 page
• 2 x passport size photograph photo with blue background
 
Mother
• Copy of Passport (biometric page only)
• Copy of Birth certificate (must be translated to English and endorsed by the Ministry of Foreign Affairs of Poland or Lithuania. For non Polish or non Lithuanian, please bring the original document and/or translated document in English for legalisation/attestation at the respective Embassy in Poland where the document original was issued)
• Copy of IC for Malaysian with front & back in 1 page (for Malaysian mother)
• Copy of Local Identity Card / Residence Card / Work Visa in Poland/Lithuania with front & back in 1 page
• 2 x passport size photograph photo with blue background
 
Child
• Copy of Birth Certificate (must be translated into English and endorsed by the Ministry of Foreign Affairs of Poland/Lithuania
• 3 x passport sized-photographs (photos that the baby faces the front and its eyes open and must be with blue background)

SITUATION 2
 
Mother is Malaysian and Father is Foreign Citizen (baby is born after marriage)
 
2. Please fill in the application form “Borang B” and Lampiran A.15(2) at the Embassy. 
 
3. The application fee is PLN10 (payable in cash or bank transfer) and PLN25 for notarial service in Lampiran A.15(2). Both parents and new born baby must be present at the Embassy of Malaysia before the baby reached 1 years old. All application must use the original forms that are available at the Embassy. Once you have filled in the forms, made a payment of PLN35 and provide complete supporting documents, your application will be sent to Jabatan Pendaftaran Negara (JPN) for consideration. In the meantime, please ensure that the baby follows the father's citizenship first.
 
4. Kindly bring along all the original documents and copies of each documents listed below in A4 size:

Mother

• Copy of Passport (biometric page only)
• Copy of Residence Card in Poland/Lithuania with front & back in 1 page  
• Copy of Birth certificate 
• Copy of Malaysia IC with front & back in 1 page
• Copy of marriage certificate (if the marriage certificate is in Polish/Lithuanian, it must be translated into English and endorsed by the Ministry of Foreign Affairs of Poland/Lithuania)
• Copy of Malaysia Marriage Registration Certificate
 
Father

• Copy of Passport (biometric page only)
• Copy of Polish/Lithuania Local Identity Card with front & back in 1 page (if the father is Lithuanian or Polish national)
• Copy of valid residence card/ work visa with front & back in 1 page (if the father is non-Lithuanian or Polish national)
• Copy of Birth certificate (must be translated from Polish/Lithuanian to English and endorsed by the Ministry of Foreign Affairs of Poland/Lithuania. For non-Polish or non Lithuanian, please bring the original document and/or translated document in English for legalisation/attestation at the respective Embassy in Poland where the original document was issued.)

Child
• 3 x passport sized-photographs (photos that the baby faces the front and its eyes open and must be with blue background)
• 1 x copy of the baby Birth Certificate (accepted language: Malay or English only - if it is in Polish/Lithuanian, please get a sworn translator to translate it first and legalized it at Ministry of Foreign Affairs Poland/Lithuania)
• 1 x Copy of document stating that the child follows the nationality of the father (eg. ID card or passport for the baby)

 

5. At the same time, if you also have any other children with your husband, grateful if you could also provide us a copy of the birth certificate of the children and copy of passport/IC of the children. These documents will be attached together with all the documents in listed in para 4.

MARRIAGE REGISTRATION

I. NON-MUSLIM MARRIAGE

A non-Muslim Malaysian citizen who has contracted a marriage in Poland or Lithuania MUST register the marriage with the Embassy of Malaysia in Warsaw within 6 months from the date of marriage. This is a legal requirement under the Law Reform (Marriage and Divorce) Act 1976 of Malaysia and it is an offence if you fail to do so within the prescribed time. The procedure requires both husband and wife to appear personally at the Embassy and produce the following documents:

i.             Filled-up JPN KC06 form (to be obtained at the Embassy);

ii.            original and copy of MyKad for Malaysian applicant (husband/wife);

iii.           original and copies of passport (details page) for both husband and wife;

iv.           copy of local identity card of non-Malaysian spouse(husband/wife);

v.           copy of residence card in Poland or Lithuania (for Malaysian applicant and non-Malaysian spouse who is nor Polish or Lithuanian);

vi.           2 recent passport size photographs of both husband and wife;

vii.          original and copy of birth certificate of non-Malaysian spouse (must be translated into English and endorsed by the Ministry of Foreign Affairs of Poland or Lithuania. For non Polish or non Lithuanian, please bring the original document and/or translated document in English for legalisation/attestation at the respective Embassy in Poland where the original document was issued);

viii.         original and copy of the marriage certificate (must be translated into English and endorsed by the Ministry of Foreign Affairs of Poland or Lithuania);

ix.           Fee of PLN 20 for the registration.  Only cash payment is accepted.

 

II. MUSLIM MARRIAGES

Muslim marriages can only be registered at the specific Jabatan Agama Islam in the state where you are registered in Malaysia. The Muslim Marriage Ceritificate issued by Imam or Mufti in Poland or Lithuania has to be translated to English, endorsed by the Ministry of Foreign Affaies or Poland or Lithuania and attested by the Embassy of Malaysia in Warsaw for it to be valid.

The procedure requires both husband and wife to appear personally at the Embassy and produce the following documents"

i.            copy of both civil marriage certificate and Islamic marriage certificate (produced by Registrar Office for civil marriage and certified Imam and Mufti in Poland for muslim marriage and must be translated into English and endorsed by the Ministry of Foreign Affairs of Poland)

ii.           original and copy of MyKad for Malaysian applicant (husband/wife);

iii.          original and copies of passport (details page) for both husband and wife;

iv.          copy of residence card in Poland (for Malaysian applicant and non-Polish or non-Lithuanian spouse);

v.           copy of Surat Kebenaran Berkahwin obtained from Pejabat Agama Islam Negeri in Malaysia

vi.          copy of conversion letter (applicable to spouse who was a non muslim before the Muslim marriage took place)

vii.         original and copy of birth certificate ( must be in English or translated to English and endorsed by the Ministry of Foreign Affairs of Poland or Lithuania. For Non Polish or Non Lithuanian, please bring the original document and/or translated document in English for attestation/legalisation at the respective Embassy in Poland where the original document was issued).

viii.        fee of PLN 50 for endorsement of marriage certificates.  Only cash payment is accepted.

 

*The Embassy will issue a letter (surat iringan) to the specific Pejabat Agama Negeri where he/she obtains her Surat Kebenaran Berkahwin. The Muslim couples have to bring the original letter back to Malaysia to file for marriage registration in person at the specific Pejabat Agama Negeri.
